Visa options for a foreign worker with a special circumstance:

Does your applicant already have an H-1B? 

The process to transfer an H-1B, rather than obtain a new one, is much simpler.  If your candidate already has an H-1B, you can file to transfer the H-1B from the current employer to your company, and the candidate will be authorized to begin employment with you upon receipt of the petition (you don’t even need to wait for the approval!).  You can read more about the process here.

Is your applicant from a special country?

There are certainly special programs for people from certain countries.  Is your applicant from:

Is your applicant someone who has worked at an organization affiliated with yours abroad?

There are a few different ways to apply for permanent residence for your employee.  Be aware that this process takes longer than a non-immigrant (or, short-term) visa, but that usually both processes can occur in parallel.  You can read more here.   

How does a startup company hire its first foreign national?

We love working with startup companies and helping assist with initial petitions.  Our process is:

  1. Have an initial consultation 

  2. Enter into an engagement agreement      

  3. Strategize which path to pursue   

  4. Send out questionnaires and checklists 

  5. Build case     

  6. File with USCIS or DOS depending on the case type     

  7. Approval – at this point, if the foreign national is outside of the country, they will need to book a consular appointment
